Restoration of driving privilege can be lengthy process

Dear Mr. Cardon,
In 1995 I was declared an Habitual Offender (“HO”) in Virginia Beach for having one DUI and two driving on suspended license convictions. I am interested in having my license privilege restored and wanted to know the process. How long does it take?

The Virginia legislature has repealed the HO statute in Virginia. Unfortunately for you, you were declared a HO before they changed the law. Therefore, the law is still in effect for you. When you were declared a HO because you had three or more serious traffic violations within a ten-year period.

HO for DUI and other serious offenses
Since you were declared a HO based on convictions for a combination of DUI and other serious offenses, you will have to wait a minimum of three years from the time you were declared an HO before you can petition the court for a restricted driving permit to drive. You will have to wait a minimum of five years from the time you were declared an HO before you can petition the court for a full, unrestricted license. While you are waiting, I recommend you do the following to make the restoration process easier to complete:

First, pay all fines and court costs that are outstanding. No judge will give you back your license until old fines and costs are paid in full.

Second, do not drive! If you are driving and are caught, not only will you face mandatory jail time and fines, also, you will make it very difficult for a judge to restore your license when the time comes. Also, do not violate any criminal laws.
