I have found from experience that judges
are unwilling to give a full unrestricted
license when you first petition the court
even if five years have passed. Typically,
the judge will give a restricted license
first, and order that ASAP continue to
monitor you for six to twelve months.
If you have done all that ASAP tells you
to do and you have no new violations,
after the six to twelve month period,
the judge will give you your full license.
HO for driving on a suspended license
only:
If the three or more serious offenses
that caused you to become a HO were convictions
for driving on a suspended license only
with no DUI convictions the process for
having your license restored is relatively
simple. First, you simply pay all fines
and costs due to the courts where you
received the ticket. Second, you file
a petition with the court asking that
your license be restored. Unlike with
HOs involving DUIs, if the HO was declared
for suspended licenses only, you can request
to have your license restored as soon
as you pay all fines and costs. You do
not have to wait the minimum three to
five years to request restoration. Also,
you do not have to be evaluated by ASAP.
