Third, get substance abuse counseling
and go to AA meetings. When you petition
the court for restoration, the court will
look to see if you have resolved any substance
abuse problems. The more you do before
you petition the court, the easier it
will be to convince the judge you are
ready to drive.
Fourth, do not drink or take drugs for
at least two years prior to petitioning
the court. If you admit to drinking or
taking drugs in the two years preceding
your petition for restoration, the judge
will most likely not grant your petition.
Finally, remain employed or find a job.
A judge will be impressed if you are employed.
If you are working and/or you have a family,
a judge will be more likely to grant you
a license, as long as you meet all the
other criteria.
Once the time has passed making
you eligible for a restricted or a full
license, you will need to file a petition
for the circuit court where you were declared
a HO. The filing fee is currently $64
and you will need to serve a copy on the
Commonwealth Attorney. On the return date,
you will go to court, and if you are eligible,
the judge will sign an order compelling
the Alcohol Safety Action Program (ASAP)
office to evaluate you. You will then
need to return to court a few months later,
after the ASAP office has met with you
and evaluated you. The evaluation will
cost you $150 and might include a drug
test and a lengthy interview about your
past, present, and future. It is your
responsibility to meet with ASAP and pay
the fees. The ASAP worker will write a
report and a recommendation and send it
to the judge and the Commonwealth Attorney.
On a new return date, the judge will decide
whether or not to grant a restricted or
full license.
