The Virginia Code invites Virginia counties,
cities and towns to adopt ordinances that
do not conflict with the state statutes
above. Some of the local ordinances that
deal with littering include:
• Litter on private property
- In Virginia Beach there is an ordinance
that mandates owners and occupants shall
keep their land in a clean and litter-free
condition. This law does not apply to storage
of refuse or litter in authorized
receptacles or containers for collection.
Violation of this ordinance is a class one
misdemeanor.
• Spitting –
In Norfolk, it is a class 4 misdemeanor
($250 fine) if you spit, expectorate, or
deposit any sputum,
saliva, mucus, or any form of sputum
on the floor, stairways or any part of any
public building or place where the
public assembles, or on any part
of any public street, alley or lane.
• Throwing lighted cigars
or cigarettes – In Norfolk,
it is a class 4 misdemeanor if you throw,
or cause to be
thrown, lighted cigars, cigarettes
or any other article of any kind from any
building or structure, causing the same
to fall on any awning or person,
or on the public streets, sidewalks or alleys.
If you see someone litter and you want to
report the violation, you should be aware
that it will be necessary for you to go
to court and testify in person against the
alleged violator. If you still want to report
the violation, follow these steps:
1. Write down a description of the person
who you saw commit the offense, a description
of the automobile or truck, and the license
plate number. You should also write down
the exact time, date and location of the
offense.
