DMV
Demerit Points: How the System Works
by David A. Cardon, Esquire
Dear Mr. Cardon,
Recently, I was convicted in Virginia Beach
for speeding, 10-19 mph above the posted
speed limit. I already have a couple of
convictions on my driving record for traffic
violations. How many Division of Motor Vehicle
("DMV") demerit points will I
receive for this recent speeding ticket?
How many points can I get before DMV suspends
my license? How do I reduce my demerit points?
When you are convicted of traffic offenses
in Virginia, the DMV assigns a certain number
of demerit points for each offense, depending
on the severity of the offense. The following
are a list of just some of the traffic offenses
grouped together by the number of demerit
points assigned:
Six Point Violations:
• Driving Under the Influence of alcohol
• Driving while license suspended
or revoked
• Reckless driving –general,
speeding 20 mph over the speed limit, racing,
or attempting to elude police
• Driving while illegally consuming
alcohol (persons under 21 years of age)
